Terms and Conditions for the Graphic Design Flatrate by CYBONDZ Unlimited
1. Scope
(1) These General Terms and Conditions (GTC) regulate all contracts concluded between CYBONDZ Unlimited and the customer for the Graphic Design Flatrate by CYBONDZ Unlimited.
(2) CYBONDZ Unlimited is represented by Adrian Bassani. The contact details of CYBONDZ Unlimited are: info@cybondz.de. Any deviating conditions of the customer will not be recognized unless CYBONDZ Unlimited expressly agrees to their validity.
(3) These GTC apply to customers who use the services of CYBONDZ Unlimited within the framework of the Graphic Design Flatrate in the exercise of their commercial or self-employed professional activity.
2. Scope of Service and Use
(1) The Graphic Design Flatrate by CYBONDZ Unlimited enables the customer to access a wide range of graphic design services at a fixed monthly price.
(2) The customer declares and guarantees that he will use the services of CYBONDZ Unlimited exclusively for lawful purposes and will not violate any applicable laws or regulations.
(3) By using the services, the customer agrees to these GTC and confirms that he is legally authorized to accept them.
3. Intellectual Property Rights
(1) All graphic design services provided within the Graphic Design Flatrate by CYBONDZ Unlimited are subject to the intellectual property rights of CYBONDZ Unlimited.
(2) The customer receives a non-exclusive, non-transferable right to use the graphic materials created within the services of CYBONDZ Unlimited exclusively for internal and business purposes.
4. Disclaimer and Limitation of Liability
(1) The services of CYBONDZ Unlimited are provided in the present state and on an availability basis. The customer uses the services at his own risk.
(2) CYBONDZ Unlimited is not liable for direct, indirect, consequential, incidental, special, or punitive damages arising from the use of the services.
(3) The customer is solely responsible for the use of the services and for any decisions he makes based on the graphic materials received.
5. Changes to the Terms and Conditions
(1) CYBONDZ Unlimited reserves the right to modify or expand these terms and conditions at any time. Changes will be communicated to the customer in a timely manner and will come into effect after a reasonable period, unless the customer objects.
(2) The customer has the right to object to the changes. In this case, CYBONDZ Unlimited reserves the right to terminate the contract.
6. Miscellaneous
(1) These terms and conditions and all related agreements constitute the entire agreement between the customer and CYBONDZ Unlimited.
(2) Should any provision of these terms and conditions be wholly or partially unlawful, void, or unenforceable, the validity of the remaining provisions shall remain unaffected.
(3) There is no partnership, co-employment, or agency relationship between the customer and CYBONDZ Unlimited.
